§ 1 Scope

(1) These General Terms and Conditions apply to all orders placed through our online shop at www.tre-alpacas.de.

(2) Our online shop is intended for consumers and businesses within the meaning of the applicable statutory provisions. A consumer is any natural person who enters into a legal transaction predominantly for purposes that are neither commercial nor related to their self-employed professional activity. A business is any natural or legal person or legally responsible partnership that, when entering into the legal transaction, acts in the course of its commercial or self-employed professional activity.

(3) Any deviating, conflicting or supplementary terms and conditions of customers shall not become part of the contract unless we expressly agree to their validity.

§ 3 Products and Presentation in the Online Shop

(1) In our online shop, we offer carefully selected alpaca products, products made from alpaca wool, as well as lovingly selected or self-designed alpaca-themed items.

(2) Product images are intended to represent our items as accurately as possible. As some of our products are natural products, wool products or individually selected items, slight variations in colour, texture, shape or finish may occur. Such variations do not constitute a defect where they are customary and reasonable for comparable products.

(3) Products made from alpaca wool may naturally vary in fibre structure, colour nuances and feel. These natural characteristics are part of what makes many of our products special and individual.

§ 4 Conclusion of the Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

(2) You may initially place products in your shopping cart without obligation. Before submitting your order, you may review and amend your entries at any time.

(3) By clicking the final order button, you submit a binding offer to purchase the goods contained in your shopping cart.

(4) The contract is concluded once we accept your order. Acceptance may take place in particular by sending an order confirmation by email, by dispatching the goods or by issuing an express declaration of acceptance.

(5) Order processing and communication generally take place by email. You are responsible for ensuring that the email address you provide is correct and that our emails can be received.

§ 5 Prices, Shipping Costs and Payment

(1) All prices displayed in our online shop are stated in euros and include statutory VAT where applicable.

(2) Shipping costs may be charged in addition to the stated product prices. The applicable shipping costs are shown during the order process.

(3) The available payment methods are displayed in the online shop and during checkout.

(4) If a payment method provided by an external payment service provider is selected, the terms and conditions of the respective payment provider shall additionally apply.

(5) Vouchers, discount codes and promotional codes may only be redeemed during the stated validity period and subject to the respective conditions. Retroactive application after an order has been completed is generally not possible.

§ 6 Delivery and Shipping

(1) Delivery is made to the shipping address provided by you.

(2) Estimated delivery times are displayed in the online shop or during checkout. If delays occur and become known to us, we will inform you accordingly.

(3) If a product is temporarily unavailable, we will inform you.

(4) If delivery is not possible due to an incorrect or incomplete shipping address, additional shipping costs may arise if the goods need to be sent again.

(5) Deliveries outside Germany may be subject to additional costs such as customs duties, taxes or fees. These shall be borne by you where legally permissible and unless otherwise stated.

§ 7 Retention of Title

The goods remain our property until full payment has been received.

§ 8 Right of Cancellation

(1) Consumers generally have a statutory right of cancellation.

(2) Details regarding the right of cancellation, the cancellation period, the effects of cancellation and the model cancellation form can be found in our separate Cancellation Policy.

(3) For certain goods, the right of cancellation may be excluded by law, for example for goods made to customer specifications or clearly personalised to individual needs. This only applies where the statutory requirements are actually met.

§ 9 Liability for Defects

(1) Statutory rights relating to defective goods apply.

(2) In the event of obvious transport damage, we kindly ask you to contact us as soon as possible. Your statutory rights remain unaffected.

(3) For natural products, alpaca wool, individually selected products or products with a natural material structure, slight variations in colour, feel, texture or size may occur. Such product- and material-specific characteristics do not constitute a defect provided that they do not impair the normal use of the product.

§ 10 Liability

(1) We shall be fully liable in cases of intent and gross negligence.

(2) In cases of slight negligence, we shall only be liable for the breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance you may regularly rely.

(3) In such cases, liability is limited to foreseeable damage typical for this type of contract.

(4) The above limitations of liability do not apply in the event of injury to life, body or health or to claims under the German Product Liability Act.

§ 11 Copyright

(1) The texts, images, product photographs, designs, logos and other content used on our website are protected by copyright unless expressly stated otherwise.

(2) Use, reproduction or modification of our content is not permitted without our prior written consent.

§ 12 Customer Reviews and Content

(1) If you submit a review or other content on our website, you agree not to publish any unlawful, offensive, discriminatory, misleading or copyright-infringing content.

(2) We reserve the right to remove unlawful or clearly inappropriate content.

(3) By submitting a review, you agree that we may display your review in connection with our online shop.

§ 13 Contract Language and Contract Text

(1) The contract language is German.

(2) We store the contract text after the contract has been concluded. The order details and these General Terms and Conditions will be sent to you by email. You may also view your order through your customer account, provided that you have created one.

§ 14 Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 15 Final Provisions

(1) German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not restrict any mandatory consumer protection provisions of the country in which the consumer has their habitual residence.

(2) If individual provisions of these General Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
